1. Scope and Provider

These Terms & Conditions apply to the use of the bookhotelstay.com platform, operated by b.web.de Internet Solutions UG (haftungsbeschränkt), Stuntzstr. 2, 81677 Munich, Germany (“we” or “bookhotelstay”). They apply to all bookings made through our platform.

2. Our Role as Intermediary

bookhotelstay is an intermediary for hotel accommodation. We display availability and pricing supplied in real time by our technology partner LiteAPI/Nuitée and forward booking requests to the respective property or its distribution system. The accommodation contract is formed directly between you and the hotel. We do not become a party to the accommodation service itself.

3. Formation of the Booking

By completing the booking process (confirming after entering guest details), you submit a binding offer to enter into an accommodation contract. The booking is concluded once you receive a booking confirmation with a booking number. Displayed prices and availability may change up until the booking is completed, as they are sourced in real time from third parties.

4. Prices and Payment

All displayed prices are in the stated currency and include statutory VAT unless indicated otherwise. Additional fees (e.g. local tourist tax, cleaning fees) may apply on-site depending on the hotel and, where known, are shown in the price breakdown. Payment is processed through our payment provider at the time of booking.

5. Cancellation and Changes

The cancellation terms of the specific rate booked apply and are shown before you complete your booking. Depending on the rate, a booking may be freely cancellable, partially refundable, or fully non-refundable. Please review the cancellation terms carefully before completing your booking.

6. Right of Withdrawal

For bookings of accommodation services for a specific date or period, German law provides no statutory right of withdrawal under § 312g (2) no. 9 BGB. Details are available on our Right of Withdrawal page.

7. Price Alert Feature

The price alert feature notifies you by email, on a non-binding basis, about price changes for a saved search. It does not create any entitlement to the originally displayed price and does not constitute an offer. You may unsubscribe from price alert notifications at any time via the link included in each email.

8. Liability

We are liable for breaches of our own obligations in accordance with statutory provisions. We do not warrant the accommodation service itself, its quality, or the accuracy of information supplied by third parties (e.g. amenities, availability), except where we are at fault.

9. Governing Law

These Terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the country in which you have your habitual residence remain unaffected.

10. Final Provisions

Should any individual provision of these Terms be invalid, the validity of the remaining provisions shall remain unaffected.
